India only: when the words and the figures differ on a cheque

Section 18 of India's Negotiable Instruments Act, 1881 says:

“If the amount undertaken or ordered to be paid is stated differently in figures and in words, the amount stated in words shall be the amount undertaken or ordered to be paid.”

The rule applies to negotiable instruments, which section 13 of the same Act defines this way: “A "negotiable instrument" means a promissory note, bill of exchange or cheque payable either to order or to bearer.” It is a rule for cheques, promissory notes and bills of exchange, not for invoices.

For cheques cleared through India's Cheque Truncation System (CTS), the Reserve Bank of India's FAQs add:

“Customers should also be aware that cheques with alteration / modification are not accepted under CTS. No changes / corrections can be carried out on the cheques (other than for date validation purposes, if required). For any change in the payee's name, courtesy amount (amount in figures) or legal amount (amount in words), fresh cheque leaves should be used by customers.”

So if the amount in words or in figures on a cheque is wrong, write a new cheque rather than correcting it. The RBI says these FAQs are issued “for information and general guidance purposes only”.
